1. Introduction

  1. This Personal Information Collection Notice (Notice) is provided to you by Hardy Piesse Pty Ltd trading as MidwithMe (ACN 675 973 547) (MidwithMe, we, our and us) to notify you of certain matters related to how we collect, handle and disclose your Personal Information as required under the Privacy Act 1988 (Cth) (Privacy Act).
  2. When we refer to “Personal Information”, we mean information or an opinion about an identified individual, or an individual who is reasonably identifiable:
    1. whether the information or opinion is true or not; and
    2. whether the information or opinion is recorded in a material form or not.
  3. When we refer to “Mums-to-be”, we mean an expectant mother who uses the MidwithMe Platform to be matched with, and connect to, a Student who can provide midwifery, pregnancy, birth and early parenting support to Mums-to-be.
  4. When we refer to “Student”, we mean a midwifery student who uses the MidwithMe Platform to be matched with, and connect to, Mums-to-be for the purpose of undertaking the CoCE component of your midwifery course or degree.
  5. When we refer to “Continuity of Care Experience” or “CoC”, we mean the teaching and learning program where midwifery students follow and support an expectant mother through her pregnancy, childbirth and early parenting.

2. Notice of collection

  1. Where you have been provided this Notice by us, we have done so to notify you that we have collected, or will be collecting, your Personal Information.

3. How we collect Personal Information

  1. We have collected or will be collecting your Personal Information when:
    1. you access or use our platform or interact using our platform or website;
    2. you contact or correspond with us via email or telephone;
    3. you enter or participate in any of our competitions, promotions, events, sweepstakes, surveys and questionnaires; and
    4. we are otherwise legally authorised or required to do so.
  2. We have collected or will be collecting your Personal Information for a third party:
    1. if you provide your Personal Information to our Authorised Affiliates (as that term is defined in our Privacy Policy) or other third parties;
    2. if you are a Mum-to-be, you have provided it to a Student;
    3. if you are a Student, you have provided it to a Mum-to-be; and
    4. if you use our social media sites or applications, pages or plugins, or third party products or services that interact with our platform.
  3. If you arrived by scanning one of our printed QR posters:
    1. the poster carries a short code that identifies the poster, not you, and scanning it records only that a scan of that poster happened on that date, with nothing that identifies you;
    2. we keep that code on your device for up to 30 days so we can tell which poster brought you to us; and
    3. if you go on to create an account, accepting this notice also records that code against your account, which tells us which location helped you find us. Where that location is a maternity hospital we treat this as Sensitive Information. You can ask us to remove it at any time.

4. Purpose of collection

Why are we collecting your Personal Information?

  1. We are collecting your Personal Information for the following purposes:
    1. as part of your engagement of us to provide products and services to you and to inform you about our product and service offerings and other opportunities;
    2. to manage, administer, improve, test, develop and upgrade our platform and inform you about it;
    3. share with our Authorised Affiliates;
    4. verification, record keeping, direct marketing, compliance purposes; and
    5. any purpose to which you have consented or any other purpose set out in this document.

5. Consequences if Personal Information is not collected

  1. Without your Personal Information we may not be able to:
    1. verify your information;
    2. provide our services to you fully and appropriately; nor
    3. ensure that we provide an easy-to-use experience for you on our platform and website and provide you with relevant information about ours goods and services.

6. Disclosure of Personal Information

Entities, bodies and persons to whom we usually disclose Personal Information

  1. We usually disclose Personal Information of the kind we have/will collect from you to:
    1. if you are a Mum-to-be, Students;
    2. if you are a Student, Mums-to-be; and
    3. our Authorised Affiliates and other representatives.

Overseas disclosure

  1. We are likely to disclose your Personal Information to entities who are located overseas in countries such as:
    1. the United States of America, in relation to customer relationship management and communications (HubSpot and Go High Level), push notifications (Google Firebase), analytics, address and location search, protection from automated abuse (Google), and error monitoring (Sentry); and
    2. other countries, in relation to the delivery of your chat messages (Ably). Ably routes messages through a global network, so the countries involved depend on where you and the person you are messaging are.

    1. we handle Personal Information;
    2. you may complain about a breach of the Australian Privacy Principles contained in the Privacy Act or a registered code which binds us and how we deal with such a complaint; and
    3. you can access your Personal Information and seek its correction.
